Scott, I have read the entire previous retort, You probably will not understand my comment. You have NO right to work, NO right to a job, NO right to feed your kids. Instead, you have the privilege of opportunity. Your acceptance of an employment offer is an agreement to provide a service to your employer in a stated fashion. If you choose to accept a job that requires drug testing, you are going to work for someone who might fire you if you test positive. You have the right to take legal action if you feel you have been mistreated per your agreement and/or any civil rights violation. As for your family, was your choice to become responsible for others. You should have done so with a reasonable concept of what it would take to pay for the care of others. The fourth amendment applies to the government, not to any organization that you waive that right for. Illegal search and seizure is only illegal if you have not consented to it, and only if it the action is taken by government. If I search your home and find drugs and take them, I have committed burglary. If you are my employee and I tell you that you cannot have the job unless you agree to testing then I am only offering you a job with stipulations. It is your choice to take the job. The reason that some jobs and some unions of workers do not have to take drug tests is that they are either too much in demand ( a workers market), or they have legal representation that has come to an agreement with the prospective employers. They are all subject to stipulations of their agreements of employment and/unions. If you feel otherwise, and I think you do, you don't understand how cruel of a world we actually live in. Yet, we live in the best country in the world, with the most privileges and most opportunities. If you feel that testing does not work, you are free to conduct reaserach and show your results and have others debate the validity of those results.
