You are either completely FOS, or you saved your lwayers life and that of
his family at one time or another.

90% of people never collect legal fees from the opposing side, regardless
of the outcome of the case. If this were not the case, the legal system in
this country wouldn't be so screwed up and this discussion would not even
be taking place.

On average you can expect to spend 3-5 years resolving any civil
litigation. Even if you do win, and are lucky enough to collect attorney's
fees, this wouldn't happen until after you have won some sort of judgment.

So are you really trying to tell me your lawyer works on a case for free
for four years, gambling on the fact that he may or may not get legal fees
at the end?

Unless all of your suits were handled by your car or home owners insurance
carrier when it's thier legal department handling the case, the picture you
paint is not even remotely close to what occurs.

And don't feel safe talking about the laws in your state. The well known
phrase 'the long arm of the law' would dictate otherwise.

The fact is that I could file a suit against you in my county, claiming
slander or libel or anythings else, and serve you in Seattle. Guess what?
Then you have to get a lawyer who can practice in MY state to respond to
the complaint. Even if you get the case dismissed on the scheduling
conference, you've spent a thousand dollars paying the local lawyer. He
won't work for free like 'your' lawyer. And you WONT win any attorneys fees
because the lawyer you found to represent you here won't even bother with
that gamble.

I so much wish your version of the legal system wasn't a complete fantasy.

E.J.
