Roger,
we need to buy a permit from the state we live in currently, although not all 
states alow the taking of lobster by ahnd (Maine does not allow it). 
You must be a resident in most cases.
For Massachusetts, there is no limit to the number taken, but they must be legal
size (measured underwater), cannot be an egg-bearing female, and you must have 
an "intact" lobster (Ex: if you have 2 lobsters, you can't have 5 claws in the 
bag).
Right now, there is no season, permits run Jan1-Dec. 31, cost $45/year.

Fines for getting caught with shorts or females can be $50/illegal lobster, 
confiscate the boat and/or dive gear.

I bring home a lobster every once in a while to placate my wife, it does make my
diving a lot easier!  :-)
