NOPE NOPE, the reason you have to be trained to fly is that when you crach you crash INTO somthing (street, house, school etc) same thing with a car. I think that if you have the money you should be able to buy the equipment. Now if you want to bundle into the price "free" training thats ok with me. I think you'd be a fool to not get trained. I also think that's it's my right to be a fool even to the extent that I kill myself! <<-- The list has often had various discussion re "my right to dive the way I want to" and Qualifications for qualifications sake etc - I believe that the (lists) concern is that we see the maufacturer's / training orgs / industry watch dogs would gain too much control & when would it stop - No Nitrox fills without the card - No trimix fills without the card - You can't buy that reg as its a high performance reg and your a novice etc etc. Dans original Question may have got lost as he rewrote - -->> The issue is, if YOU were sold a rebreather which was supposed to be easy for you, but found out later that it was far beyond your abilities to use, and that you could not get your money back, would it be your fault for being suckered, or the fault of all manufacturers for not putting in safeguards to prevent this. <<-- Maybe the question should be - if YOU bought a rebreather of which a training course (for those who needed it ie < X hours on a rebreather of same or similar design) AND an MANDATORY acceptance test/exam were part of the overall cost and you failed the exam could you have your money back - I'd say yes for the equipment costs and NO for a proportion of the fee which was the exam, would those who took the training get the training fee back - NO : the fee is paid to attend the training course, the certificate/qualification is earned during the course as someone else said - failure to achieve acceptable skill set (and attitude) = no qualification.
