Sean -

You're wrong about this -- "loser pays" systems just screw the little 
guy, insulate the big guy from responsibility, and do nothing to help the 
vast majority of us in the middle, like all small businesses.  I'd be 
happy to say more about it off the list since I don't want to subject 
everyone else to an off-topic discussion.

Although good samaritan laws vary from state to state, almost everything 
that's been said on the list about dive club liability is flat out wrong, 
starting with the fact that dive masters don't usually fall into the 
"professional" exception (it requires a 3-4 year degree).

The only people who have gotten it right are Al Marvelli and George, as 
usual.
