Now, on to tank filling, testing, and cleaning as it relates to 49CFR parts 172 & 173 49CFR =A7 173.34 (a)(1) states that "No person may charge or fill a cylinder unless it is as specified in this part and part 178 of this sub chapter. A cylinder that leaks, is bulged, has defective valves or safety devices, bears evidence of abuse, fire or heat damage, or detrimental rust or corrosion, must not be used unless it is properly repaired and requalified as prescribed in these regulations." I guess that lets you off the hook Rick. Not one word about festering puss balls or privately owned scuba tanks. Only persons. However, as I stated before I=92m afraid I must comply. 49CFR =A7 173.34 (e) "Periodic qualification and marking of cylinders. Eac= h cylinder that becomes due for periodic retest as specified in the following table must be retested and marked in conformance with the requirements of this paragraph (e)" The table indicates that 3A, 3AA cylinders be tested to "5/3 times service pressure (see paragraph =A7173.34 (e)(13)" retest period "5, 10, or 12 years (see =A7173.34 (e)(14), (e)(12), (e)(16), and (e)(19))." 3AL cylinders have SIMILAR but different requirements. No mention of who must comply. You might be able to make the case that because no mention of stupid festering puss balls appears in any of the relevant code you are, again, exempt. However, as I stated before I=92m afraid I must comply. 49CFR =A7 173.2a classifies and describes "hazardous materials". Non-flammable compressed gas is a Class 2 Division 2.2 according to 49CFR =A7 173.2a. 49CFR =A7 172.101 contains the "HAZARDOUS MATERIALS TABLE" refers to such gases as "Air, compressed", "Helium, compressed", "Rare gases and oxygen mixtures" and "Oxygen, compressed" as well as pages of other liquid, solid and gaseous items. 49CFR =A7 173.115 (b) titled "Division 2.2 (non-flammable, non-poisonous compressed gas -including compressed gas, liquefied gas, pressurized cryogenic gas, compressed gas in solution, asphyxiant gas and oxidizing gas)" further describes the gases included in this part of the code. 49CFR =A7 173.1 (b) states, in part, "A shipment of hazardous materials that is not prepared in accordance with this subchapter may not be offered for transportation by air, highway, rail, or water." This covers you. Even a putrid stupid festering puss ball must not offer for transportation any class of hazardous material not prepared in accordance with the relevant code. Even if contained in privately owned scuba tanks. 49CFR =A7 173.302 (a)(5)(iii) gives the specifications for federally require= d cleaning of 3AL cylinders "used in oxygen service,..."=20 Enough of the 49CFR =A7 .... adnausium crap!
