CO2 is not toxic.  It is breathed out otherwise it would attain anesthetic 
concentration and you go to sleep, or are you asleep?

Oxymoron,  diving PHYSIOLOGY is not PHYSICS.  His symtpoms were NEUROLOGICAL 
not mechanical or thermodynamic.
