In North Carolina and several other states, it is perfectly legal to tape a telephone conversation IF at least one of the parties knows it is being taped, i.e., a third party may not legally tape a telephone conversation without a court order, but one of the two parties may do it without informing the other. Quoting the conversation if you identify yourself as a reporter is perfectly legal even if you don't say you are going to quote. It may be unethical but perfectly legal. And it may be legal to quote someone if you do not identify yourself as a reporter. There is a saying among icthyologists that even a fish wouldn't get into trouble if they kept their mouth shut.
