Our equivalent Down Under (Aussie) are the various State Govt WorkCover 
Authorities or their equivalents.  They have authority over any recreational 
diving where there is a workplace involved.  A workplace is basically anywhere 
where there is commercial gain ie dive stores, charter boats, dive sites where 
an instructor is teaching etc.

A similiar scene applies in the UK where recreational diving instructors have 
to be registered as commercial divers.

I am sure that Occupational Health & Safety legislation will catch up with the 
US recreational diving industry in due course
