That is to say, it's still medical O2, it's just that it can be administered without a prescription for EMERGENCY use by a TRAINED person. No definition of training - it's up to the state to set. Some say it means EMT or paramedical, not just someone who has taken a 3 hour DAN course, most don't say anything. The other interesting thing, is that getting a prescription doesn't really cover you either (if you really give a damn about being legal which most of us don't) - a prescription allows use of it to treat a medical condition in the person named, not just unlimited fun use. For example, a doctor can't write a prescription for speed for recreational use, nor can you if you have a legitimate prescription give the stuff away to others. So even if you get a prescription for medical O2, you are probably still breaking the law by using it for diving, and definately if you give it to friends, and your doctor is probably breaking the law by writing it. Also, you are breaking the law if you use it for mixing - transfilling of medical O2 by a non-licensed facilitly is illegal, as is putting it into non-approved, non-labeled containers. That is, according to the FDA. The regs are very badly written and often ambiguous and it would be very amusing to watch them try to prosecute someone for a violation.
