Jammer Six says: > Maybe that's what scares you guys. cant speak for others, but i am not scared of a lawsuit. i do this all day for a living. > The ability to pay the lawyers? I don't know. I never paid him. The > people who sued me paid him. > very uncommon to collect legal fees in the united states. where do you live? (cant tell from your made up name etc. perhaps you lost one suit too many and are hiding?) > > Look, Honey, we got another bad ass. > More like someone who is intimately familiar with the legal system and knows somewhat more about it than you. > >and if you were "held liable for injuries, damages" etc. as you > said below, > >tell us, what did you do to deserve it? must have been pretty bad to be > >actually HELD liable, since most cases settle. Want to tell us about it? > > Of course not. > > Suffice it to say that I was doing something that I shouldn't have been > doing, Like Derek? Which is how this thread started. And since you havnt told us what happened (like Derek) we can now assume you were at fault...?? > > Over the years, I've been sued for everything from breach of contract to > specific performance, So you have been sued numerous times, and won. would not those suits then be classified as frivolous? even if you do collect fees, isnt the time drain an issue for you? it is for most. > > Lawsuits are great tools if you have a case, but they're really the wrong > approach if you don't. If you're wrong, you need to make nice-nice. If > you're right, blast away. Lots of people collect because the insurance company finds it easier to settle than to fight. And if you force them to press forward they may NOT have to reimburse you if the settlement offer would have been for less. > > Frivilous suits, in which the people sueing you have no case, or in which > you've just been caught in the "shotgun" tactic of some new lawyer, (real > lawyers don't use this tactic) simply aren't to be feared. > Total Bullshit; real lawyers do this all the time. I see it every day in silicon valley, with MILLIONS of dollars changing hands. Litigation in this country is unbelievably expensive. It is almost always cheaper to settle. > If you sue me, you need to have a case. Otherwise, you'll be paying my > lawyer, and since that's the case, be my guest. Either you dont live in the U.S. or you have been the extreme exception. Dont try that out here. you may win but not much of a chance to get reimbursed either. > > Speaking as a businessman, it really does seem like the way to go. > Speaking as a lawyer, i would avoid the suit in the first place unless all you like to do is waste time fighting frivoulous suits. Unless of course you live almost anywhere other than the United States where the loser pays the lawyers. -- Send mail for the `techdiver' mailing list to `techdiver@aquanaut.com'.
