There is a difference between the scenario of a bus driver and a boat
operator. In our sport, training is required. No training required for skiing
(or for getting mugged :) ), so who is held responsible during a ski
accident?? Since we require training, we wind up being responsible.

As long as training is required for Scuba diving, boat captains (IMO) should
be held more responsible than a bus driver. Its a question of to what degree.
Again, we want self regulation, but no one wants the responsibility. 

I don't think that boat captains should be responsible for the equipment a
diver uses, but should require cert. cards for various dives. For example, and
I may be wrong on this:

The Dive boat Seeker requires a tri-mix certification to dive the Doria, but
does not require that you dive mix on the trip. Initially this sounds like a
good idea to me; it is a way of making sure that there is some level of
training for a dive of that nature, but they let you dive the way you are
comfortable diving.

Capt. Zero, you have a "boat is full list" for certain individuals on certain
dives, but you would take them on "easier dives" that they are capable of. How
can a boat captain make this call?? Well, the only way is by checking c-cards
and log books, or by haveing personal knowledge of the diver and the dive in
question.

But then there are the boat captains that don't care, and only care about the
boat fee. For example, "Jane Diver" new enough not to ask you to take her to
the Doria, but yet Jane is on another boat, borrowing equipment, without
training, on her way to the Doria. Is THAT boat captain irresponsible?? Again,
this is about "self regulation". If we don't wake up and regulate, big brother
will.

And I am not picking on just boat captains here (ahhh, I am not really
picking, we are all in this together), we have the same problem with Agencys
and instructors.
