My understanding is that a prescription for oxygen is only required when its purpose is for a medical need, and none is required for recreational use. I think that the only restriction is that scuba tanks must be filled at sites that are authorized by the FDA (e.g. permit holders). So diving on nitrox would be classified as recreational and would therefore not require a prescription. The problem that may arise is when oxygen is given as emergency treatment of DCS as I would have thought that this would probably be then classed as 'a medical need'. Sue
