Such are the risks of diving with buddies.  Yes, it was the diver's fault.

What happened to Win was a tragedy.  It really sucks.  It is also a risk 
he accepted when he got in the water, just as getting creamed by a drunk 
driver is a risk weaccept everytime we venture on the freeway.  We make 
laws to minimizes the number of drunk drivers on the road. We should make 
laws to minimize the chance that some boob is driving a boat or carrying 
a speargun.  Lawsuits are not the answer - they make life too miserable 
for too many innocent people - they are an extremely inneficient means of 
retribution. They don't bring the dead back to life; they don't give a 
crippled person the ability to walk again.  Some things should not be 
measured in dollars.
