Sergei, > copyright for images >and text stays with the author, and is non-transferrable - only the >publishing rights can be transferred. It should not be confused with >trademarks. This statement is completely incorrect. Copyright may be transferred - it can be sold like any other piece of tangible property. When you create an image, you own the copyright and are granted 5 exclusive rights. These are the right to: reproduce the work, prepare derrivative works, distribute the work, performthe work, and display the work. If anyone does any of these things with an image that they did not create, they are in violation of copyright unless they have a written agreement with the creator, or have purchases the copyrights to the material. Copyright can be transferred, and there are 'fair use' doctrines that allow materials to be used without agreement. However, an 'educational' site for a for profit entity like AUL - this is like an infomercial on TV. The courts have already spoken - education for profit of advertisers is not free education, and are not allowed the rights that public schools have with respect to 'fair use'. -WES
