Are you sure this is a public list? I think it could be argued that the list manager COULD, if he wanted, restrict access to the list by whatever criteria he saw fit. The list would therefore be exclusive to those who were "allowed on" and correspondence could be considered to be of a private nature between "members" of the list. Depending upon the reguatory jurisdiction involved (as far as this form of electronic communication is concerned, that would be a substantial issue in itself) you could be violating laws of privacy and/or copyright by republishing material from the list without permission of its authors.
