I talked to OSHA and the Federal Register office today and confirmed that Dixie Divers application for variance to allow their instructors to use nitrox while teaching was finally approved last week and will be published by the Federal Register on December 20, only two years after being submitted. The OSHA website is www.osha.gov do a search under "Dixie Divers". The Federal Register website is www.nara.gov/fedreg/. In a nutshell for those of you who are unaware it is/was a violation of U.S. federal OSHA regulations/laws for an instructor who is employed by a company (dive shop) to use nitrox while teaching the company's (dive shop's) students. Seems that OSHA likes to classify that as commercial diving. I would like to see a consensus from the attorneys who subscribe to the lists on whether or not they believe that this variance will apply to all instructors, after you've had a chance to read all 79 pages of the variance of course.
