A couple of points here: Instructor insurance in Canada cost less than half what it does here in the US. Common sense tells us the reason the charters in canada aren't concerned about lawsuits is because they have better tort reform, not because they are not assumming any liability, they just aren't worried about frivolous lawsuits. The following facts were were presented by a insurance agent for one of the major rec training agencys at a recent diving conference. Although it was scuba specific it still applys to charters. 1) If an instructor is directly or indirectly involved in a scuba accident( ie.. knowingly allowing someone to make a dive they are not qualified for, like just being present on the dive boat) THEY WILL BE SUED. 2) Even if the case does not stand a chance the lawsuit will CONSUME AT LEAST 3 YEARS OF YOUR LIFE. You will eat, breathe, and sleep lawsuit. 3) Most instructors involved in a lawsuit never teach another class again. Negligent or not. You can damm well bet when I charter Bryce's boat anyone blowing their deco or exceeding they're qualification level will not be diving again. People with this attitude aren't worth jeopardizing everything I have worked for. I do agree with you on one point, Sunshine Coast Tours is the best charter I've been on, around the world. None of these boats have ever even asked to see a C Card, and two of them announce, formally, that all diving, decompression, and choices are up to me, that they are specifically not involved. You then sign a waiver that says exactly that, and are left alone to do as you wish. One of them (Sunshine Coast Tours) is the finest "tech" boat in B.C., and will let you do anything you want, and will go out of their way to make sure you have the helium and oxygen to do it. Why? Because they don't want any liability, and "captains" foolish enough to place requirements on divers or dives assume some level of liability by doing so. The liability follows the responsibility, and the responsibility follows the person who makes the choices. Make any of the choices, and you assume some of the liability. Stay out of the police business, and you assume none of the liability.
