While I agree with your sentiment on rights, the right of "life, liberty,
and the persuit of happiness" is not a constitutional right.  That phrase
doesn't appear anywhere in the constitution or bill of rights.  It comes
from the Declaration of Independence.  Although a nice document, it has no
legal power.
