  In my past life - Instructing in Hawaii (Somebody has to do it) - They 
implemented the fine system $50.  first offense  $100.  Second and the $300 for 
third and subsequent fines for not flying a dive flag.  

Obviously there inforcement was hit an miss - however - they hit the sites where
there was significant instruction and or divers in the water and their key was 
the use of a float with no flag.

Could be. Our club was ticketed for the same thing in Vermont.
