On 5/21/97 16:22, you said:

>If someone says "Don't sue me -- I followed
>established gas industry procedures" you can undercut it with "But did
>you follow the _dive industry_ rules?" And if you're a shop that follows
>the dive industry rules and an accident still happens, you can undercut
>the defense with: "Did you 02 clean this particular tank before you
>filled it? No -- then how do you know it was properly 02 cleaned? You
>don't -- when then weren't you negligent in filling a tank that you
>didn't personally know was 02 cleaned?" At that point, it's a little too
>late to say: Well the dive industry's 02 cleaning standards are
>unnecessary bullshit that I really didn't have to follow..."

So what you're saying is that you loose no matter which standard you
follow?

An excellent reason to do what works, and to hell with the legal eagles.

I note that the best in game, WKPP, Sunshine Coast Tours, (and, until
recently,) Seasport Scuba, Rendezvous Dive Adventures, base absolutely
nothing on liability.

Sunshine Coast Tours frequently forgets to have his waivers signed, but
then, at his level of expertise, it hardly matters.

Ask George how many decisions he makes on the basis of liability.

I'll bet a year's income that the answer is a very round number, indeed.

My expertise in my field (I'm a General Contractor) is high enough that I
pay no attention to liability. It never matters. I would never allow an
issue to get that far.

I've said it many times before, that if you're concerned about liability,
you're not good enough at what you're doing to be doing it professionally.

If dive "professionals" taught Personal Responsibility instead of
Liability Protection, we would all be better off.
