divers in new york state can get lobsters in two ways, one get a permit
from the state of new york for resident non-commercial lobster permit for
about five dollars, which allows a bag limit of six lobsters, a
non-resident permit is more costly. or if you dive off a commercial dive
boat most of them have a commercial federal and state permit which you
would be taking the lobster under , then there is no bag limit ( like a
lobster trap fisherman) but you still must follow the size, two claws
only per lobster, and no eggs guide lines with ether method. the captain
has to report the amount of catch of every kind of fish and shellfish
taken to national marine fisheries in triplicate each trip and send in
the forms each month.dives from out of state , or out of the country can
take lobster or shellfish when diving from a charter boat with the proper
permits, or fishing from a party fishing boat .
